The following terms and conditions, as well as any future modifications (the "Terms") are a contract between you or your company ("you" or "your") and Capture ("Capture," "we," "us," or "our") in addition to any other agreement you may have with Capture. By using Capture websites, including, but not limited to capture.techulus.in, software applications and application programming interfaces (collectively, the "Services"), you acknowledge that you have read, understood, accept and agree to be bound by the most recent version of these Terms.
Capture ("capture.techulus.in") reserves the right to modify or replace these Terms of Service at any time and in Capture sole discretion. Capture will indicate at the top of these Terms of Service the date such document was last updated. Any changes will be effective immediately upon posting the revised version on the Site (or such later effective date as may be indicated at the top of the revised Terms of Service). Your continued use of the Site or Service following the posting of any changes to these Terms of Service will constitute your acceptance of such changes. If you do not agree to the changes, you must stop using the Site and Service. In addition, Capture may provide other methods by which you may accept these Terms of Service or changes to these Terms of Service.
Grant of Limited License
Subject to compliance with the Terms, Capture hereby grants you a non-exclusive, non-transferable, revocable, worldwide license to access and use the Services. All rights not expressly granted to you are reserved by Capture and its licensors. Some Services may require creation of an account through a registration or signup process. Further, some Services may require payment of fees in order to activate your account. The limited license to use and access these Services is further limited by your accurate and successful creation of an account and providing proper payment as may be required. If You violate the Terms, we reserve the right in our sole discretion to terminate your limited license without notice.
Fees
Capture reserves the right to charge fees for your use of the Services, as described during the account registration process or when making changes to your account plan. Capture is not obligated to provide refunds or credits for partial months of the Services, upgrades or downgrades, or unused time during your subscription. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. You agree to pay for any such taxes that might be applicable to your use of the Services and payments made by you herein.
PLEASE NOTE THAT DOWNGRADING YOUR ACCOUNT MAY RESULT IN THE LOSS OF CONTENT, FEATURES, OR CAPACITY OF YOUR ACCOUNT. Capture DOES NOT ACCEPT ANY LIABILITY FOR ANY SUCH LOSSES.
Modifications to the Services
We reserve the right, in our sole discretion, to change published prices without notice. Furthermore, we reserve the right to change the prices for the Services tied to your account, provided that Capture notifies you at the email address associated with your account within thirty (30) days in advance of any such change. Capture reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. Capture shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Services.
Refund and Cancellation Policy
Capture may terminate your account without notice in the event that you breach any of these Terms. In the event of any termination, Capture will not refund any of the prepaid Fees. Such termination of the Services will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. Capture reserves the right to refuse service to anyone for any reason at any time.
